Terms of Service (Required)  

  1. Article 1 (Purpose)

    The purpose of these Terms of Service is to set forth the rights, obligations and responsibilities under which “CYBERSKYSHOP”, ‘Jeju Pure Water’ and ‘Korean Air Online Logo Shop(hereinafter “e-SKYSHOP”)’ operated by Cybersky Co., Ltd. provide online service (hereinafter “Service”).

  2. Article 2 (Definitions)
    1. 1. "CYBERWORKSHOP" refers to a virtual sales operation established to provide products and services (hereinafter "Products") for Users using information communication facilities, and it also refers to the business owner operating the cyber shopping mall.
    2. 2. “User” refers to both members and non-members who access to “CYBERSKYSHOP” and use the services provided by “CYBERSKYSHOP” under these Terms of Service.
    3. 3. ‘Member’ refers to a person who has registered as a member of “CYBERSKYSHOP” and is able to continue to use the service provided by “CYBERSKYSHOP”.
    4. 4. ‘Non-member’ refers to a person who uses the service provided by “CYBERSKYSHOP” without having registered.
  3. Article 3 (Revision & Explanation of Terms of Service)
    1. 1. "CYBERSKYSHOP" shall post these Terms of Service, company name, representative's name, office address (including the address of customer complaint handling unit), phone number, fax number, e-mail, business registration number, online sales registration number, and personal information manager at the first service screen (first page), provided, however, that the Terms of Service may be linked to another page.
    2. 2. “CYBERSKYSHOP” shall link the important aspects of the Terms of Service including cancellation of order, responsibility of delivery and return policy or display in a pop-up message to make sure that Users can read them prior to agreeing to the Terms of Service.
    3. 3. "CYBERSKYSHOP" may revise these Terms of Service under “Act on the Consumer Protection in the Electronic Commerce Transactions, etc.”, “Act on the Regulation of Terms and Conditions”, “Electronic Financial Transaction Act", “Digital Signature Act”, “Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.”, “Act on Door-to-Door Sales, etc.” and “Framework Act on Consumers.”
    4. 4. "CYBERSKYSHOP" shall announce any amendment of these Terms of Service and specify the date of effect and reason for the amendment on the home screen of the website at least seven (7) days prior to its effect. However, in the event of change made that is disadvantageous to Users, “CYBERSKYSHOP” shall notify the User with at least a thirty (30) day advance grace period. In this case, "CYBERSKYSHOP" shall make sure that the Users can understand the change in a clear manner through comparison.
    5. 5. Any change made by "CYBERSKYSHOP" to the Terms of Service shall affect the agreement signed after the effective date of the revision. However, if the User who has already entered into the agreement agree to the amended terms within the period defined under Article 3 hereof, such amendment shall apply to the Users.
    6. 6. Any matters not specified hereunder and the interpretation hereof shall be governed by the Act on the Consumer Protection in the Electronic Commerce Transactions, etc., Act on the Regulation of Terms and Conditions, Consumer Production Guidelines in the Electronic Commerce Transactions, etc. and other applicable laws and commercial practice.
  4. Article 4 (Service Offer & Change)
    1. 1. “CYBERSKYSHOP” shall:
      1. ① provide information about the products or services and sign purchase agreement;
      2. ② deliver products and services under purchase agreement; and
      3. ③ perform other works determined by “CYBERSKYSHOP”.
    2. 2. “CYBERSKYSHOP” may change the contents of its products or services in future contract in the event of any change in the technical specification and selling out of products or services. In this case, such changes and the date of provision shall be announced on the site where such products and services are posted.
    3. 3. “CYBERSKYSHOP” shall notify its Users of any change in the contents of service agreed by the Users in the event of sold-out of Products or change in technical specifications through valid means of communication.
    4. 4. “CYBERSKYSHOP” shall compensate for any damage caused to the Users in accordance with the previous provision, unless “CYBERSKYSHOP” proves that such damage is not caused by its fault or negligence.
  5. Article 5 (Discontinuation of Service)
    1. 1. “CYBERSKYSHOP” may temporarily discontinue its service in the event of maintenance, repair, replacement and failure of information communication facilities and disconnection of communication service.
    2. 2. “CYBERSKYSHOP” shall compensate any damage caused to the Users or a third party in accordance with Article 5-1 hereof, unless, “CYBERSKYSHOP” proves that such damage is not caused by its fault or negligence.
    3. 3. “CYBERSKYSHOP” shall notify the User of its discontinuation of service by the method set out in Article 8 hereof and compensate the consumers under the conditions defined if the service cannot be provided due to the change in business areas, business abandonment and merger. However, if "CYBERSKYSHOP" fails to announce any policies on compensation, it shall compensate miles or credits in cash or cash equivalent to commercial value available at “CYBERSKYSHOP”.
  6. Article 6 (Membership Registration)
    1. 1. Users shall create an account by filling out the registration form provided by “CYBERSKYSHOP” and agreeing to these Terms of Service.
    2. 2. "CYBERSKYSHOP" shall approve such registration in accordance with Paragraph 1 hereof unless:
      1. ① the applicant has lost membership under Article 7-3 hereof, unless such applicant has been approved by “CYBERSKYSHOP” for registration after three (3) years;
      2. ② there is any error, or false or missing information; or
      3. ③ it is deemed that registration causes technical interference to “CYBERSKYSHOP”.
    3. 3. The membership agreement shall be deemed complete at the time when the acceptance of “CYBERSKYSHOP” is sent to the Member.
    4. 4. In the event of any change in the account information, the Member shall notify “CYBERSKYSHOP” of such change by editing its account information.
  7. Article 7 (Closing Account & Loss of Membership)
    1. 1. The Members may close their account at any time and “CYBERSKYSHOP” shall approve their request immediately.
    2. 2. “CYBERSKYSHOP” may restrict or suspend membership if:
      1. ① the Member provides any false information on their registration form;
      2. ② the Member fails to make payment on their purchase and other service within the set period of time by using “CYBERSKYSHOP”;
      3. ③ the Member interferes with other persons’ use of “CYBERSKYSHOP”, abuse information or cause disruption of electronic commerce; or
      4. ④ the Member abuses “CYBERSKYSHOP”, disrupt public order, or violates laws or these Terms of Service.
    3. 3. If the Member commits the same action twice or fails to correct it within thirty (30) days after “CYBERSKYSHOP” suspended their membership, “CYBERSKYSHOP” may terminate their membership.
    4. 4. When "CYBERSKYSHOP" terminates membership, the account shall be deleted. In this case, the Member shall be notified and given a chance to raise any objection within at least thirty (30) days.
  8. Article 8 (Notice to Members)
    1. 1. “CYBERSKYSHOP” may communicate with the Members through the e-mail address agreed by the Members.
    2. 2. “CYBERSKYSHOP” may post any announcement on its website for at least one (1) week instead of individual notice unless it has significant impact on the transaction with individual members.
  9. Article 9 (Order)
    1. 1. “CYBERSKYSHOP” Users shall place order using the following method whereas “CYBERSKYSHOP” shall provide the following information to facilitate the placement of order:
      1. ① search and selection of the Product
      2. ② Entry of shipping information including the name of recipient, address, phone number, e-mail (or mobile number)
      3. ③ confirmation of the Terms of Service, service not subject to the rights for withdrawal of subscription, shipping rate and installation cost
      4. ④ Means of acceptance to these Terms of Service and confirmation/refusal of the items specified in subparagraph 3 above (e.g. mouse click)
      5. ⑤ Product order, its confirmation or acceptance to the confirmation by “CYBERSKYSHOP”
      6. ⑥ selection of payment method
    2. 2. In the event that "CYBERSKYSHOP" provides User's personal information to a third party, it shall acquire the User's consent at the time of purchase, not at the time of membership registration. In this case, "CYBERSKYSHOP" shall inform the User of the information provided, recipient, purpose of disclosure, period of retention and use, unless it is required otherwise pursuant to Article 25 Paragraph 1 of the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.".
  10. Article 10 (Establishment of Agreement)
    1. 1. "CYBERSKYSHOP" may not accept orders in the following events, provided, however, that it shall inform Users that it may cancel the agreement with minors if they fail to obtain consent from their legal guardian:
      1. ① Error, or false or missing information in the order
      2. ② Purchase of prohibited products or services including cigarettes and alcoholic beverages by minors under the Juvenile Protection Act
      3. ③ Under any circumstances that it is deemed that such acceptance causes technical interference with business operation
    2. 2. The agreement is deemed established when the acceptance of “CYBERSKYSHOP” is delivered to the User in the form of order confirmation notice under Article 12 Paragraph 1.
    3. 3. The acceptance by “CYBERSKYSHOP” shall include the confirmation of order, availability of sales and information about the change in order and cancellation.
  11. Article 11 (Payment)

    “CYBERSKYSHOP” may require payment for the products or services purchased by the Users using one of the following methods, provided, however, that “CYBERSKYSHOP” shall not charge any fee on the specific payment method chosen by the User:

    1. 1. Bank transfer e.g. phone banking, internet banking, mail banking
    2. 2. Card payment including pre-paid card, debit card and credit card
    3. 3. Online bank transfer
    4. 4. Electronic currency payment
    5. 5. Payment at the time of delivery
    6. 6. “CYBERSKYSHOP” points including miles
    7. 7. Gift certificate affiliated with or accepted by “CYBERSKYSHOP”
    8. 8. Any other electronic payment methods
  12. Article 12 (Order Confirmation Notice & Order Change/Cancellation)
    1. 1. “CYBERSKYSHOP” shall notify the Users of their order confirmation when orders are placed.
    2. 2. Upon receipt of order confirmation, the Users may request change or cancellation of the order in the event of any discrepancy or error in the order whereas “CYBERSKYSHOP” shall accept such request before shipping the order, provided, however, that Article 15 hereof shall apply if the payment has been already made.
  13. Article 13 (Supply of Products)
    1. 1. ① “CYBERSKYSHOP” shall take necessary measures including manufacturing of products and packaging within seven (7) days from the date of order unless specified otherwise on the shipping schedule. However, if payment has been already made, in part or whole, “CYBERSKYSHOP” shall take measures within three (3) business days. In this case, “CYBERSKYSHOP” shall take necessary measures to ensure that the Users can check the process of order and its status.
    2. 2. “CYBERSKYSHOP” shall specify shipping method, bearer of shipping cost and shipping schedule by method. However, if “CYBERSKYSHOP” fails to deliver the order within the agreed period, it shall compensate any damage caused to the User unless “CYBERSKYSHOP” proves that such damage is not caused by its fault or negligence.
  14. Article 14 (Refund)

    “CYBERSKYSHOP” shall notify the User immediately in the event that it is unable to provide or deliver the order due to sold-out or any other reasons and refund or take necessary measures to process the refund within three (3) days from the date receipt of payment.

  15. Article 15 (Cancellation)
    1. 1. The Users who entered a purchase agreement with “CYBERSKYSHOP” may cancel the agreement within seven (7) days from the date when they receive the confirmation of the agreement in writing (or the Product whichever is later) under Article 13 Paragraph 2 of the Act on the Consumer Protection in the Electronic Commerce Transactions, etc. unless provided otherwise in the Act on the Consumer Protection in the Electronic Commerce Transactions, etc.
    2. 2. The User shall not return or exchange the Product after delivered if:
      1. ① the Product has been lost or damaged due to the fault of the User unless the package has been removed or damaged to check the content of the Product;
      2. ② the value of the Product has been significantly reduced due to the consumption of its part or use;
      3. ③ the resale value of the Produce has been considerably diminished due to lapse of time;
      4. ④ the Product can be duplicated and the package has been damaged; or
    3. 3. In the event of Paragraph 2 Subparagraph 2 to 4, the User's right to cancel the agreement shall not be limited unless stated otherwise by “CYBERSKYSHOP” in a place where the User can easily check.
    4. 4. In the event that the agreement has not be honored or the Product is not as described or advertised, the Users may cancel their agreement within three (3) months from the date of receipt of the Product or thirty (30) days from the date when they recognize such discrepancy.
  16. Article 16 (Effect of Cancellation)
    1. 1. “CYBERSKYSHOP” shall refund the payment within three (3) business days from the date when the Product is returned. In this case, “CYBERSKYSHOP” shall pay any interest in accordance with Article 21 Paragraph 2 of the Act on the Consumer Protection in the Electronic Commerce Transactions, etc. for each day of delay in payment.
    2. 2. In the event that the aforementioned payment has been made by credit card or any electronic currency, “CYBERSKYSHOP” shall take necessary measures to refund or cancel the payment immediately.
    3. 3. The User shall bear any cost of returning the Product in the event of cancellation of the agreement whereas “CYBERSKYSHOP” shall not charge any fee or penalty for cancellation unless it is canceled on the ground that the Product is not as described or advertised.
    4. 4. If the User pays shipping cost, “CYBERSKYSHOP” shall state the responsibility of such cost in a clear, easy-to-understand manner.
  17. Article 17 (Personal Information Protection)
    1. 1. “CYBERSKYSHOP” shall collect personal to the extent it is needed for providing services for the User.
    2. 2. “CYBERSKYSHOP” shall not collect information in advance for the performance of purchase agreement, unless required for personal identification purpose under the laws.
    3. 3. “CYBERSKYSHOP” shall inform the User of the purpose of collection and use of Personal Information in advance.
    4. 4. “CYBERSKYSHOP” shall not use Personal Information for any purpose other than the one for which it was collected and if there is a need for new purpose, it shall inform the Users and obtain their consent, unless provided otherwise by the laws.
    5. 5. In the event that “CYBERSKYSHOP” requires the Users' consent under Article 17 Paragraph 2 and Paragraph 3 hereof, it shall state or notify the identity of Personal Information manager(title, name, contact information), purpose of collection and use of Personal Information, matters related to third party disclosure (recipient, purpose of disclosure, information to be disclosed) pursuant to Article 22 Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. whereas the Users may withdraw their consent at any time.
    6. 6. The Users may request access or correction of their Personal Information retained by “CYBERSKYSHOP” at any time whereas “CYBERSKYSHOP” shall take necessary measures immediately. If the Users request correction of errors in their Personal Information, “CYBERSKYSHOP” shall not use such data until such correction is made.
    7. 7. “CYBERSKYSHOP” shall limit the number of persons who have access to Personal Information and take full responsibility of any damage caused to the Users in the event of loss, theft, leakage, unauthorized disclosure and modification of Personal Information including credit card and bank account.
    8. 8. “CYBERSKYSHOP” or any third parties who receive Personal Information from it shall destroy Personal Information immediately when the purpose of collection or disclosure is achieved.
    9. 9. “CYBERSKYSHOP” shall leave the consent box for collection, use and disclosure of Personal Information unchecked and specify the result of not providing consent for the Users in detail. It shall not limit or refuse to provide the membership service if the Users refuse to give their consent to the collection, use and disclosure of Personal Information which is not required for providing services.
  18. Article 18 (Duties of “CYBERSKYSHOP”)
    1. 1. “CYBERSKYSHOP” shall not violate these Terms of Service or disrupt public orders and provide products and services in a consistent manner in accordance with these Terms of Service to the best of its ability.
    2. 2. “CYBERSKYSHOP” shall establish a security system to protect the Personal Information of the Users including credit information to make sure to provide online service in a safe manner.
    3. 3. “CYBERSKYSHOP” shall take responsibility for any damage caused to the Users in the event that it violates Article 3 of the Act on Fair Indication and Advertisement when it comes to indication and advertisement of the products and services.
    4. 4. “CYBERSKYSHOP” shall not send any commercial advertisement by e-mail to the Users unless agreed by the Users.
  19. Article 19 (Duties of the Members on ID/Password)
    1. 1. The Members shall be responsible for protecting their own ID and passwords except for the cases under Article 17 hereof.
    2. 2. The Members shall not allow any 3rd parties to use their own ID or password.
    3. 3. If the Members learn that their ID/password has been stolen or used by a third party, they shall notify “CYBERSKYSHOP” immediately and follow their instructions.
  20. Article 20 (Duties of the Users)

    The Users shall not:

    1. 1. provide false information when creating an account or editing their account information;
    2. 2. steal other person's information;
    3. 3. modify the information posted on “CYBERSKYSHOP”;
    4. 4. Transmit or post any information (e.g. computer software) other than the one permitted by "CYBERSKYSHOP";
    5. 5. Infringe the copyright or any intellectual property right of “CYBERSKYSHOP” or any 3rd parties;
    6. 6. Damage the reputation of “CYBERSKYSHOP” or any 3rd parties or interfere with their business operation; and
    7. 7. display or post any sexual or violent messages, videos and audio, or any contents that may disrupt public order.
  21. Article 21 (Relationship between Connecting "Mall" and Connected "Mall")
    1. 1. If an upper-tier "mall" and lower-tier "mall" are connected through hyperlinks (e.g. hyperlinks included in texts, images and videos), the former is referred to as a connecting "mall" (website) and the latter connected "mall" (website).
    2. 2. The connecting "mall" shall not be responsible for any transaction of the Products exclusively made by the connected "mall" if the connecting "mall" announce its waiver of such responsibility on the first page of its website or a pop-up window.
  22. Article 22 (Ownership of Copyright & Restriction of Use)
    1. 1. “CYBERSKYSHOP” shall hold exclusive copyright and any other intellectual property right on the contents it created.
    2. 2. The Users shall not duplicate, transmit, publish, broadcast or use for commercial purpose any information owned by “CYBERSKYSHOP” without prior consent of “CYBERSKYSHOP” or allow such use by any 3rd party.
    3. 3. In the event that “CYBERSKYSHOP” uses any contents copyrighted by the User, “CYBERSKYSHOP” shall notify the User accordingly.
  23. Article 23 (Dispute Resolution)
    1. 1. “CYBERSKYSHOP” shall establish and operate a system that will collect and reflect the Users' feedback or complaints and compensate for any damage caused to the Users.
    2. 2. “CYBERSKYSHOP” shall put priority on handling complaints and feedback submitted by the Users, provided, however, that it shall notify the Users of the reason and schedule if it fails to provide the solution on time.
    3. 3. Any dispute arising between “CYBERSKYSHOP” and the Users regarding electronic transactions may be resolved by the arbitrator designated by the Fair Trade Commission or governor of the city/province if requested by the Users for resolution.
  24. Article 24 (Jurisdiction & Governing Law)
    1. 1. Any dispute between “CYBERSKYSHOP” and the Users regarding electronic commercial transactions will be settled at a court within the jurisdiction of the User's address or local district court with competent jurisdiction. However, if the User's address or residence is not clear or lives outside South Korea, the competent court will be designated under the Civil Proceedings Act.
    2. 2. The Law of South Korea shall apply to dispute between “CYBERSKYSHOP” and the Users.
    3. 3. You may refuse to consent, but you will not be able to use the services for the members provided by “CYBERSKYSHOP”.

    Cybersky Co., Ltd. collects the minimum amount of personal information for membership, information, and delivery of goods.

        • Information for product delivery and details: e-mail, telephone number, mobile number, date of birth

        • Information for personal services: address, SKYPASS number
    2. 2. Method of Personal Information Collection

      Cybersky Co., Ltd. collects Personal Information using the following methods.

      • website, written form, consultation through phone, Q&A, promotional event, shipping order
      • disclosure from partners
      • collection through a generated data collection tool : Service usage log, access log, cookies, access IP information, transaction log, denied access log
  • Purpose of Collection and Use of Personal Information
    1. 1. Cybersky Co., Ltd. collects personal information to provide various services and information and more service benefits using several methods (e.g. phone, notice, e-mail)
    2. 2. Cybersky Co., Ltd. uses the Personal Information it has collected for the following purposes:
      • Processing payment for service and contents charges, billing and shipping, identification for financial transactions and financial services, payment for purchases and charges, and collecting outstanding payments
      • Membership management

        Identifying membership service, identifying individuals, preventing abuse and unauthorized use, confirming membership registration, restricting registration or multiple registration, confirming the registration consent for children under 14 from their legal guardians, identifying legal guardians, retaining records for dispute resolution, handling complaints and sending notices

  • Period of Retention and Use of Personal Information

    In principal, Personal Information is immediately destroyed after the purpose of collection is complete and the retention period expires.

    However, the following Personal Information is retained for a specific period:

    • Member ID
      • Purpose of Retention: for smooth delivery of Service
      • Period of retention: up to 10 years from the date of membership termination under the Commercial Act.

        The membership account information is stored for a certain period of time if required by laws including the Act on the Consumer Protection in Electronic Commerce, etc. In this case, the Company uses the Personal Information for the purpose of retention and store it for the following period:

    • Records of non-anonymous promotional events and surveys
      • Purpose/basis: temporary purpose of conducting event or survey
      • Period of retention: at the time of account closing
    • Records of agreement and withdrawal of subscription
      • Purpose of Retention: Act on the Consumer Protection in Electronic Commerce, etc.
      • Period of retention: 5 years
    • Records of payment and supply of the Product
      • Purpose of Retention: Act on the Consumer Protection in Electronic Commerce, etc.
      • Period of retention: 5 years
    • You may refuse to consent, but you will not be able to use the services for the members provided by “CYBERSKYSHOP”.

    The Company provides options to "agree" or "not agree" to its Privacy Policy and the Terms of Service. When the users choose to agree, they are deemed to have agreed to the collection of their Personal Information. For collection or user of any other items, any purposes other than collection and use of Personal Information, disclosure to third parties, and retention and use of prescribed period, the Company states it on its Privacy Policy and is required to obtain their consent through the "User Consent for Protection of Personal Information".

    Cyber Sky Co., Ltd. Collects the following Personal Information for the purpose of membership registration, consultation and service:

    • Required data: name, email address, phone number, mobile phone number, date of birth, boarding information, payment details, business registration number and name of company(business entity)
    • Optional data: address, SKYPASS number

      In the course of using the Service or operating business, the following data may be generated and collected:

    • Service usage records, access logs, cookies, access IP address, payment details, user suspension records

    Cyber Sky Co., Ltd. collects Personal Information using the following methods:

    • website, written form, consultation through phone, Q&A, promotional event, shipping order
    • disclosure from partners

    1. 1. Cyber Sky Co., Ltd. collects Personal Information for provide various services and information and more service benefits using several methods (e.g. phone, notice, email).
    2. 2. Cyber Sky Co., Ltd. uses the Personal Information it has collected for the following purposes:

    3. 3. Cyber Sky Co., Ltd. does not collect any data that may infringe human rights or sensitive data (e.g. ethnicity, race, personal belief, place of origin, political inclination, criminal records, health conditions, sexual orientation).
  4. 4. Right to Decline Collection and Use of Personal Information

    Cyber Sky Co., Ltd. collects only data that is needed to provide service. The users have the right to decline such collection and use of their Personal Information. However, in this case, their use of the Service may be restricted.

  5. 5. Disclosure of Personal Information

    Cyber Sky Co., Ltd. does not disclose the users' Personal Information to third parties in principle. The Personal Information is strictly used within the scope defined in "Types and Method of Personal Information Collection" and "Purpose of Collection and Use of Personal Information" and not disclosed to third parties without the consent of the users.

    However, the following exception applies:

Cyber Sky Co., Ltd. outsources a minimum amount of Personal Information to be processed by third parties and does not use or disclose Personal Information for any purpose other than agreed without the consent of the users. If there is a need for such use or disclosure in the future, the Company will notify the users and obtain their consent in advance.

    In general, Cyber Sky Co., Ltd. destroys Personal Information immediately after its purpose of collection and use is achieved using the following procedures and methods:

      • The Personal Information provided by the users for membership registration is destroyed after a certain period of time when the purpose of collection is achieved pursuant to the internal policy (refer to the period of retention and use) and other applicable laws. The said Personal Information is not used for any purpose other than retention as required by the laws.
    2. 2. Methods
      • The Personal Information printed on paper is shredded or incinerated.
      • Electronic files containing Personal Information are deleted permanently beyond recovery.
  9. I. Rights of User and Legal Representatives

    The users may view or update their own Personal Information or close their membership account at any time.

    The users may view, update or close their membership account by clicking on "Update Personal Info." (or "Update Account Information") or "Close Account".

    Or the users may contact the Personal Information Manager in writing, or by phone or email for prompt response.

    The Company does not use or provide Personal Information until it is updated if the users request correction of any errors in the Personal Information.

    If incorrect Personal Information has been provided to a third party, the corrected data will be notified to the third party immediately.

    Cyber Sky Co., Ltd. processes Personal Information deleted or that of a closed account upon request and make sure that such Personal Information cannot be access or used in accordance with the "Period of retention and use of the Personal Information".

  10. J. Installation/Operation of Automatic Personal Information Collection System and Refusal Thereof

    Cyber Sky Co., Ltd. installs/operates automatic Personal Information collection systems including cookies which store and find Personal Information. A cookie is a small text file which is sent by the website server to the browser and stored in the PC's hard disk.

    Cyber Sky Co., Ltd. uses cookies for the following purposes:

      • Analyzing the frequency and time of access by members and non-members, identifying areas of interest and preferences of users, and participation of various events and number of visitors for target marketing and personalized service offers

  12. L. Transmission of Advertising Information
    1. 1. Cyber Sky Co., Ltd. does not transmit any advertising information without the expressed consent of the users.
    2. 2. If the users give their consent to receive newsletters and other email messages, Cyber Sky Co., Ltd. makes sure that they are easy to notice by including the following:

Consent to Collection of Location Data (Optional)  

  1. Chapter 1 General Provisions
    1. Article 1 (Purpose)

      The purpose of these Terms is to set forth the rights, responsibilities and any matters under which the customers who entered into an agreement for the location-based service (hereinafter the "Service") provided by Cybersky Co., Ltd. (hereinafter the "Company").

    2. Article 2 (Effect & Amendment)
      1. ① These Terms shall apply to all customers who intend to use the Service.
      2. ② The content of these Terms shall be effective when it is displayed on the service screen or announced to the customers in any other way and the customer subscribes for the Service.
      3. ③ If deemed necessary, the Company may amend these Terms and in this case, the Company shall announce the effect of such amendment and the reasons in detail pursuant to Article 2 Paragraph 2 hereof at least seven (7) days prior to the date of effect, provided, however, that the Company shall make such announcement at least thirty (30) days prior to the date of effect and notify the customers individually if such amendment is not favorable to the customers. However, if the customers fails to provide their valid contact information, they may be deemed as being notified.
      4. ④ In the event that the User do not express their refusal to the amendment pursuant to Article 3 hereof even through the Company notified the User that the amendment will be deemed as agreed to if they do not express their refusal, it shall be deemed that the customers have agreed to the amendment. The customers may stop using the Service and terminate the user agreement if they do not agree to the amendment.
    3. Article 3 (Additional Provisions)

      Any matters not specified hereunder shall be determined in accordance with the Act on the Protection, Use, etc. of Location Information (hereinafter the "Location Information Act"), Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (hereinafter "Information Network Act") and Personal Information Protection Act as well as other applicable laws and the service policies established by the Company.

  2. Chapter 2 Use of the Service
    1. Article 4 (Membership Requirements)
      1. ① The customers shall be the owner of the mobile device with a support of location-based service (hereinafter "Device") which is required for the use of the Service.
      2. ② Companies may subscribe for the Service using their company registration number.
    2. Article 5 (Subscription of Service)

      The Company may not approve the subscription of the Service if the customer:

      1. ① uses other person's identity or provides false information on their registration form;
      2. ② fails to complete the registration form or provides incorrect information;
      3. ③ subscribe to the Service to disrupt public order; or
      4. ④ fails to meet the requirements set by the Company.
    3. Article 6 (Cancellation of Subscription)

      The customers may unsubscribe the Service by following the process (announced on/offline or through the website) set by the Company.

    4. Article 7 (Quality of Service)
      1. ① The Service shall be available 24 hours a day, 7 days a week, unless there is a technical or operational maintenance period set by the Company. In this case, the Company shall announce the schedule before and after.
      2. ② The Location Information may be subject to a certain margin of error depending on the technological development.
    5. Article 8 (Restriction & Suspension of Service Use)

      The Company may restrict or suspend the use of the Service if the customer:

      1. ① uses another person's name (resident registration number) to join the Service;
      2. ② interfere with other persons' use of the Service or use other persons' Personal Information without authorization; or
      3. ③ violates laws or disrupts public order.
    6. Article 9 (Modification & Cessation of the Service)
      1. ① The Company may restrict, modify or cease the Service, whether in part of or in whole, if:
        1. 1. required due to service maintenance;
        2. 2. it is unable to provide the Service due to blackout, interruption of facilities and over-usage; or
        3. 3. a force majeure event occurs including operational or legal interruption, natural disaster and termination of partnership with affiliated companies.
      2. ② The Company shall announce such service interruption through the website under Article 9 Paragraph 1 hereof or notify the customers individually, provided, however, that if such announcement or notification is not available due to system failure (e.g. disc failure, system down not caused by the operator), the Company may announce or notify later.
    7. Article 10 (Service Types & Charges)

      The types and charges for the Service shall be specified in Appendix 1.

  3. Chapter 3 Protection of Personal Location Information
    1. Article 11 (Definitions of Location Information)
      1. ① "Location Information" shall refer to the data of mobile objects or location where individuals exist or has existed in a specific time (including current location and visitation record) collected using electric communication facilities and electric communication wire facilities.
      2. ② The Company shall acquire Location Information from the customers who have agreed to these Terms and use of Location Information and shall use such data in accordance with the purpose of the Service.
    2. Article 12 (Protection of Personal Location Information)

      The Company shall protect the customers' Location Information to the best of its ability pursuant to applicable laws and regulations.

    3. Article 13 (Use or Disclosure of Location Information)
      1. ① The Company may use Location Information collected to provide the Service and the customers shall be deemed to have agreed to the use of Location Information if they agree to these Terms.
      2. ② The Company shall not use Location Information for any purpose other than providing the Service without the consent of the customer.
      3. ③ The Company shall notify the customers through the mobile phone number or e-mail address designated by the customers if:
        1. 1. the Device that collects the Location Information does not support text messaging, voice or video reception; or
        2. 2. the subject of Location Information has requested notification to the Device or e-mail address.
      4. ④ In the event that the Company discloses Location Information to any 3rd parties designated by the Members, it shall inform them of the recipients, and date and purpose of disclosure each time or the frequency determined by the Company pursuant to the Location Information Protection Act.

        However, the Company may notify the content of such 3rd party disclosure on a regular basis if they obtain consent from the customers as follows:

        1. 1. the number of times and period of notification
        2. 2. the fact that the customers may be notified immediately and how to request such notification if required by the customer
    4. Article 14 (Retention of Proof of Using/Disclosing Location Information)
      1. ① The Company shall automatically make a record of using and disclosing Location Information through the Location Information system and retain that information for six (6) months from the date of recording to deal with any complaints from customers pursuant to Article 16 Paragraph 2 of the Location Information Act.
      2. ② In the event that the customers withdraw their consent, whether in part of in whole, the Company shall destroy their Location Information and information about using and providing Location Information (or a part of the Location Information and information about using and providing Location Information if the consent has been withdrawn partially), unless required otherwise under the Framework Act on National Taxes, Corporation Tax Act and Value-Added Tax Act, and any other applicable laws.
    5. Article 15 (Period of Retention and Use of Location Information)

      The Company shall not use Location Information of the customers for any purposes other than agreed by the customers pursuant to Article 16-2 of the Location Information Act and retain the record of using and providing Location Information for six (6) months pursuant to Article 23 thereof, after which period the Company shall destroy the information immediately.

    6. Article 16 (Rights of Legal Guardian)
      1. ① The Company shall obtain the consent of legal guardians when using Location Information of children under 14 years of age under Article 18 Paragraph 1, Article 19 Paragraphs 1 and 2, or Article 21 of the Location Information Act.
      2. ② Article 17 (Rights of Customer) shall apply when the legal guardian provides their consent pursuant to Article 25 Paragraph 2 of the Location Information Act. In this case, the legal guardian shall be considered as the customer.
    7. Article 17 (Use of Location Information for Children under 8)
      1. ① The Company shall acknowledge the consent of the following children under 8 years of age (hereinafter "Children under 8" if their legal guardians give their consent for the purpose of protecting the children's life or ensuring their safety:
        1. 1. Children under 8 years of age
        2. 2. adults subject to guardianship
        3. 3. Persons with mental disabilities under Article 2 Paragraph 2 Subparagraph 2 of the Act on Welfare of Persons with Disabilities and serious disabilities under Article 2 Paragraph 2 of the Act on Employment Promotion and Vocational Rehabilitation for Disabled Persons (registered as persons with disabilities under Article 32 of the Act on Welfare of Persons with Disabilities)
      2. ② The guardian of the Children under 8 shall refer to those who protect the children as follows:
        1. 1. legal guardians of Children under 8 or guardians under Article 3 of the Act on the Guardianship of Minors in Protective Facilities
        2. 2. legal guardians of adults subject to guardianship
        3. 3. Legal guardians under Article 17 Paragraph 1 Subparagraph 3 hereof, directors of welfare facilities for persons with disabilities (operated by the federal or local government) under Article 58 Paragraph 1 Subparagraph 1 of the Act on Welfare of Persons with Disabilities, directors of social welfare facilities for persons with mental disabilities under Article 3 Paragraph 4 of the Mental Health Act, and mental rehabilitation facilities under Article 3 Paragraph 5 of the Mental Health Act.
      3. ③ The legal guardians shall submit the documents to prove their legal guardianship in order to give their consent to the collection and use of Location Information for the safety of Children under 8.
      4. ④ Article 18 (Rights of Customer) shall apply when the legal guardian provides their consent pursuant to Article 26 Paragraph 4 of the Location Information Act. In this case, the legal guardian shall be considered as the customer.
  4. Chapter 4 Rights and Obligations of Company and Customer
    1. Article 18 (Obligations of Company)
      1. ① The Company shall respond to any complaints from customers regarding the Service immediately and notify the customer of the reason and schedule for resolution in the event that there is any delay.
      2. ② The Company shall comply with the Act on the Protection, Use, etc. of Location Information, Telecommunications Business Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. and Personal Information Protection Act as well as other applicable laws and regulations related to the operation and maintenance of the Service.
      3. ③ The Company may use personal information and information about the Service usage collected during registration in order to improve the Service and providing marketing for new products, event announcements and survey. However, the Company shall obtain the consent from the customers when using the information outside the scope of the consent or disclose information to a 3rd party whereas the customer may refuse to give such consent.
      4. ④ Before requesting registration of user for bad credit with the credit information agency and other relevant institutions under Article 17 of the Use and Protection of Credit Information Act, the Company shall perform necessary identification processes for the user.
    2. Article 19 (Rights of Customer)
      1. ① The customers may withdraw their consent to the use and disclosure of Location Information, whether in part of in whole, online.
      2. ② The customers may ask the Company to temporarily stop using and disclosing their Location Information online.
      3. ③ The customers may request the following information to be notified or accessed and may request correction if such information has any errors:
        1. 1. proof of collection, use and disclosure of Location Information
        2. 2. The reason for disclosing Location Information to 3rd parties and disclosed content under the Location Information Act and other applicable laws
    3. Article 20 (Obligations of Customer)
      1. ① The customers shall pay the service charge on time and notify the Company of any change in billing address and contact information in accordance with the Service agreement.
      2. ② The customers shall provide and register accurate and complete information required for the use of the Service and update such information promptly when needed.
      3. ③ The customers shall maintain their Devices to prevent any interruption of the Service due to their malfunction and repair or exchange them if needed.
      4. ④ When using the Service, the customers shall not:
        1. 1. provide any false information when registering or updating their information;
        2. 2. damage other persons' reputation or cause any disadvantages to others;
        3. 3. distribute any information, texts, shapes or voice that may disrupt public orders;
        4. 4. register or distribute any computer virus that can cause disruption, malfunction or damage to the Service facilities or information;
        5. 5. pose as another person or provide false information about the relationship with other persons;
        6. 6. distribute false information to gain profit or cause damage to other persons;
        7. 7. abuse or leak other persons' Personal Information gained while using the Service; or
        8. 8. engage in any illegal or inappropriate actions.
      5. ⑤ The customers shall follow the applicable laws, these Terms, Service guides and rules set by the Company and shall not interfere with the Company operation.

    2. Article 22 (Assignment)

      The customers and Company shall not assign or transfer the titles, rights or obligations, whether in part of in whole, to a 3rd party or use as a guarantee.

    3. Article 23 (Indemnification)
      1. ① The customers shall indemnify the Company against any loss or damages arising out of or in connection with its breach of these Terms.
      2. ② The customers shall indemnify the Company against any legal claims or lawsuits brought to the Company by a 3rd party in the event that such claim or lawsuit has been caused by the customers, whether intentional or not.
      3. ③ The Company shall indemnify the customers against any loss or damages arising out of or in connection with the Service or its breach of Article 15 or 26 of the Location Information Act.
    4. Article 24 (Disclaimer)
      1. ① The Company shall not be responsible for its failure to provide the Service in the event of force majeure.
      2. ② The Company shall not be responsible for any interruption of the Service caused by the customers.
      3. ③ The Company shall not be responsible for any loss of expected revenue through the Service or damages caused by the information gained through the Service.
      4. ④ The customers shall make final decision on the Service and information they acquire using the Service and take full responsibility of its consequence. The Company shall bear no responsibility of any loss arising out of it.
      5. ⑤ In the event that the Company fails to provide the Service due to its work process or technology, the Company shall notify by email or announce it on the website. However, the Company may announce it later due to circumstances beyond its control.
    5. Article 25 (Dispute Resolution & Jurisdiction)
      1. ① Any disputes related to the Service between the Company and customers shall be resolved amicably based on mutual discussion and agreement.
      2. ② In the event that such dispute is not resolved pursuant to Article 25 Paragraph 1 hereof, the Company and customers may submit to the Korea Communications Commission or the Personal Information Dispute Mediation Committee for resolution pursuant to Article 28 of the Location Information Act (established by the Korea Communications Commission) and Article 43 of the Personal Information Protection Act (request for resolution).
      3. ③ In the event that such dispute is not resolved pursuant to Article 25 Paragraph 2, the Company and customers may submit to the competent court under the Civil Procedure Act.
